Privacy Policy

1. Key Definitions

TG Ai Messenger — the software product "TG Ai messenger", a mobile application for Android and iOS, and a desktop application for Windows, macOS and Linux (hereinafter — "TG Ai", "Messenger").

Operator — DESTRUCTION LLC, processing personal data of Messenger Users.

User — a person using the Messenger and/or a personal data subject.

Personal Data — any information relating directly or indirectly to an identified or identifiable individual (personal data subject).

Processing of Personal Data — any action (operation) or set of actions performed on personal data, whether automated or not: collection, recording, organization, storage, modification, retrieval, use, transfer, anonymization, blocking, deletion, destruction.

Content — all information posted by the User through the Messenger, including text messages, images, audio and video files.

AI Features — artificial intelligence features built into the Messenger: AI photo enhancement, AI chat (assistant), voice message recognition.

Tokens — an internal unit of account used to pay for AI features of the Messenger.

Telegram — software whose terms of use are available at telegram.org/tos.

2. General Provisions

2.1. This Privacy Policy (hereinafter — "Policy") defines the general principles, purposes, procedures and conditions of processing Users' personal data by the Operator.

2.2. The Policy has been developed in compliance with the requirements of Federal Law No. 152-FZ dated 27.07.2006 "On Personal Data" (hereinafter — No. 152-FZ).

2.3. The Messenger is built on the open-source code of Telegram, license: GNU General Public License v2.0.

2.4. All Content (messages, contacts, channels, groups) is processed by Telegram servers under Telegram's terms. The Operator does not process or store the User's messages, contacts or other Content, except for data explicitly described in sections 5 and 6 of this Policy.

2.5. By authorizing and using the Messenger, the User consents to the processing of their personal data under the terms of this Policy.

2.6. Personal data processing is carried out by the Operator on the territory of the Russian Federation.

2.7. The Operator reserves the right to amend the Policy. The updated version takes effect upon publication.

2.8. In accordance with No. 152-FZ, the User has the right to:

  • access their personal data;
  • obtain information regarding the processing of their personal data;
  • request correction, blocking or destruction of personal data;
  • take measures provided by law to protect their rights.

3. Purposes of Personal Data Processing

The Operator processes personal data for the following purposes:

  • ensuring Messenger functionality and device registration;
  • providing AI features (processing requests, generating and enhancing images);
  • token accounting and transaction processing;
  • determining User location for proper connection routing (proxy);
  • displaying advertising materials;
  • ensuring security and preventing fraud;
  • improving Messenger quality based on anonymized usage statistics;
  • communicating with Users for notifications and handling inquiries;
  • fulfilling obligations under the laws of the Russian Federation.

4. Legal Basis for Processing

4.1. The Operator processes personal data with the consent of the personal data subject.

4.2. Upon achieving the processing purposes or upon withdrawal of consent, personal data shall be destroyed, unless otherwise provided by an agreement between the Operator and the User.

5. Categories of Personal Data

The Operator may collect and process the following data:

5.1. Device Data

Device identifier, model, operating system version, system language — for device registration and ensuring proper Messenger functionality.

5.2. Account Data

Telegram user identifier (tgUserId), country (determined by SIM card or IP address), registration date, Messenger settings.

5.3. Geolocation Data

The User's country is determined by IP address using the MaxMind GeoLite2 database for connection routing (proxy server selection) and displaying relevant advertising. Precise coordinates (GPS) are not collected by the Operator.

5.4. AI Feature Data

When using AI features, the Operator processes:

  • text messages sent to the AI assistant;
  • images submitted for AI enhancement;
  • voice messages submitted for recognition;
  • AI conversation history (stored on the Operator's servers).

AI data is stored for the duration of Messenger use. The User can delete their AI conversations through the application. Upon account deletion, all AI data is destroyed.

5.5. Transaction Data

Token balance (free and paid), token operation history (charges, credits, top-ups), type of AI feature used.

5.6. Ad Impression Data

The fact of ad display, ad identifier, display time — for statistics and ad selection.

5.7. The Operator does not collect or process biometric data.

5.8. All data is provided personally by the User or generated automatically during Messenger use.

6. Data Processing for AI Features

6.1. To provide AI features, the Operator transmits User data to third-party AI service providers:

  • OpenAI, Inc. (USA) — text request processing, image generation and enhancement, voice message recognition. Privacy policy: openai.com/policies/privacy-policy.
  • Anthropic, PBC (USA) — text request processing. Privacy policy: anthropic.com/privacy.

6.2. Only data directly necessary to fulfill the request is transmitted: message text, image or audio recording. Account personal data (identifier, phone number) is not transmitted to AI providers.

6.3. AI request data is processed by AI providers in accordance with their own privacy policies. The Operator is not responsible for data processing by AI providers after transmission.

7. Connection Routing (Proxy)

7.1. To ensure stable connectivity, the Messenger may automatically route traffic through the Operator's proxy servers. In this case, the User's IP address passes through the proxy server.

7.2. Proxy servers do not store the content of transmitted data. The connection between the Messenger and Telegram servers is encrypted using the MTProto protocol.

8. Transfer of Personal Data to Third Parties

8.1. The Operator does not transfer personal data to third parties, except in the following cases:

  • transfer of data to AI service providers for AI request processing (section 6);
  • payment processing by payment service providers;
  • compliance with the requirements of Russian Federation legislation upon request of authorized government bodies.

9. Data Update, Deletion and Destruction

9.1. The User can obtain information about the processing of their personal data, as well as request modification or deletion, by contacting the Operator via the Telegram support bot: @tgai_supportbot.

9.2. The Operator responds to inquiries within 10 business days. The period may be extended by no more than 5 business days with notification to the User.

9.3. Upon account deletion, all User personal data, including AI conversations and transaction history, is destroyed.

10. Personal Data Protection Measures

10.1. The Operator takes the necessary legal, organizational and technical measures to protect personal data from unauthorized access, destruction, modification, blocking, copying, distribution and other unlawful actions.

10.2. Measures include:

  • appointing a person responsible for personal data processing;
  • implementing technical information security measures;
  • controlling access to personal data;
  • detecting and preventing unauthorized access;
  • regular audits of data processing compliance with No. 152-FZ requirements.

11. Cookies

11.1. The Operator's website (tgai.app) may use technical cookies for proper functioning.

11.2. The Messenger (mobile application) does not use cookies.
