1. General Provisions

1.1. These Terms of Service (hereinafter — "Terms") govern the relationship between DESTRUCTION LLC (hereinafter — "Operator") and the user of the TG AI app (hereinafter — "User") regarding the use of the software product "TG AI", a Telegram client (hereinafter — "TG AI", "App").

1.2. The App is built on the open-source code of Telegram (GNU General Public License v2.0) and is a Telegram client with additional artificial intelligence features.

1.3. By using the App, the User fully and unconditionally accepts these Terms and the Privacy Policy.

1.4. If the User does not agree with these Terms, they must stop using the App.

1.5. The Operator reserves the right to unilaterally modify these Terms. The current version is available at tgai.app/terms. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. Subject of Agreement

2.1. The Operator grants the User a non-exclusive, non-transferable license to use the App under the conditions set forth in these Terms.

2.2. The App provides access to Telegram messaging features as well as the Operator's additional AI features: AI photo enhancement, AI chat (assistant), voice message recognition, chat message summaries, writing help. Additional features are available with the paid TG Plus Subscription (section 6).

2.3. Messaging features (chats, channels, groups, calls) are provided by Telegram under Telegram's terms (telegram.org/tos). The Operator is not responsible for Telegram services.

3. Registration and Account

3.1. To use the App, the User authenticates through their existing Telegram account. No separate registration with the Operator is required.

3.2. The User is responsible for the security of their authentication data and for all actions performed using their account.

3.3. The User agrees not to share access to their account with third parties.

4. AI Features

4.1. The App provides AI features, including:

  • AI photo enhancement — image processing using neural networks to improve quality;
  • AI chat — text-based dialogue with artificial intelligence for answers, text generation and other tasks;
  • Voice message recognition — converting voice messages to text;
  • Summaries — a short summary of selected chat messages;
  • Writing help — rewriting, fixing, changing the tone of or translating message text.

4.2. AI features are provided "as is". The Operator does not guarantee the accuracy, completeness or reliability of AI results.

4.3. The User independently evaluates the suitability of AI results for their purposes. The Operator is not liable for decisions made based on AI results.

4.4. To provide AI features, User data (text, images, audio) is transmitted to third-party AI service providers. The list of providers and details are in the Privacy Policy.

5. Token System

5.1. AI features are paid for using tokens — the App's internal unit of account.

5.2. Each User receives free tokens daily. The free token limit is set by the Operator and may be changed.

5.3. The User may purchase additional tokens for money.

5.4. Purchased tokens are non-refundable and cannot be exchanged for money. By purchasing tokens, the User confirms awareness of this condition.

5.5. Purchased tokens do not expire and have no expiration date.

5.6. Free tokens are credited daily and do not accumulate: unused free tokens do not carry over to the next day.

5.7. The cost of AI features in tokens is determined by the Operator and may be changed. Current rates are available in the App.

5.8. Tokens are not electronic money, securities or any other financial instrument.

6. TG Plus Subscription

6.1. The TG Plus Subscription (hereinafter — "Subscription") is a paid subscription to additional TG AI features. The features, price, term and available payment methods are shown on the Subscription screen in the App before payment and may differ by platform, app store and country.

6.2. The Subscription is tied to the Telegram account it was purchased from and works for that account on every device where the App supports the Subscription and the User is signed in with that account; the set of available features may depend on the platform. Each Telegram account subscribes separately.

6.3. The Subscription is paid via the App Store, Google Play or Telegram Stars. Charges are made by Apple, Google or Telegram using the payment details the User has provided to them; the Operator does not receive payment details.

6.4. The Subscription renews automatically for each next period (one month, or 30 days when paid with Telegram Stars) at the price in effect at renewal, until the User cancels it. To avoid renewal, cancel the Subscription at least 24 hours before the end of the current period: the app store may charge for the next period within 24 hours before it begins.

6.5. The Subscription can be cancelled at any time: if purchased via the App Store — in the Apple ID subscription settings on the device; via Google Play — in Subscriptions in the Google Play app; via Telegram Stars — on the Subscription screen in the App or in the Telegram Stars section of Settings. After cancellation, the Subscription remains active until the end of the paid period and is not renewed.

6.6. Deleting the account or the App does not cancel the Subscription — it must be cancelled as described in clause 6.5.

6.7. If a Subscription purchased via the App Store or Google Play is not shown in the App, it can be restored with the "Restore purchases" button on the Subscription screen.

6.8. Refunds for a Subscription paid via the App Store or Google Play are handled under Apple's or Google's rules respectively. Refunds for payments with Telegram Stars are handled by the Operator: send a request to the support bot @tgai_supportbot. The User may also contact this bot with any payment question.

6.9. The Operator may change the Subscription price. The new price applies to subsequent periods in the manner set by the app store — with notice to the User and, where the store's rules require it, with the User's consent. The price of a Subscription already purchased with Telegram Stars does not change.

6.10. Subscription AI quotas are granted per billing period and do not carry over to the next period. Tokens purchased separately are kept regardless of the Subscription.

6.11. Subscription purchases in the App Store and Google Play are also governed by the terms of the respective store.

7. Connection Routing

7.1. The App may automatically use the Operator's proxy servers to ensure a stable connection to Telegram servers.

7.2. Proxy server selection is automatic based on the User's location (country).

7.3. Proxy servers only provide transit of encrypted traffic and do not access message content.

8. Prohibited Use

The User is prohibited from:

  • using the App for spam, fraud or other illegal activities;
  • distributing illegal content through AI features, including hate speech, violence, child exploitation material;
  • attempting unauthorized access to the Operator's servers and systems;
  • using automated tools (bots, scripts) for mass use of AI features bypassing established limits;
  • reselling or transferring tokens to third parties;
  • decompiling, modifying or creating derivative products based on the server-side of the App (this restriction does not apply to client code distributed under GPLv2).

9. Intellectual Property

9.1. The App's client code is distributed under the GNU General Public License v2.0. Source code is available under this license.

9.2. The server-side (backend), AI integrations, trade name "TG AI", logos and design elements that are not part of Telegram's open source are the intellectual property of the Operator.

9.3. Messaging features are provided by the Telegram platform. The Operator does not own the messaging service — these features are only displayed in the App.

10. Limitation of Liability

10.1. The App is provided "as is". The Operator does not guarantee uninterrupted and error-free operation of the App.

10.2. The Operator is not liable for:

  • interruptions in Telegram services;
  • quality, accuracy and reliability of AI feature results;
  • losses arising from the use or inability to use the App;
  • actions of third parties (AI providers, payment systems, Telegram);
  • data loss due to technical failures.

10.3. The Operator's total liability to the User is limited to the amount actually paid by the User for tokens and the Subscription in the last 12 months.

11. Governing Law and Dispute Resolution

11.1. These Terms are governed by the laws of the Russian Federation.

11.2. All disputes shall be resolved through negotiation. If agreement cannot be reached, disputes shall be submitted to the court at the Operator's location.
